COURT DECLARES! FOBI TO BE SWORN IN
The Judicial board hearing the case brought against the Electoral commission of the University of Ghana’s Student Representative Council challenging the validity of the elections of Davis Ohene Fobi as the SRC president of the University of Ghana has declared its judgement in the afternoon of Monday 4th May 2015.
The case which was brought against the electoral commission of the University of Ghana by Jeffery Kwabena Yeboah and Worlu Great Damzi who are all students of the University of Ghana requested the judicial board of the SRC to look into the circumstances that saw Davis Ohene Fobi elected as the new SRC president of the University of Ghana.
The judicial board this Monday ordered the swearing in of Davis Ohene Fobi who is the SRC president elect. This was after his counsel Nana Benyin moved a motion on the floor of the house on Sunday 3rd May 2015 for his client to be sworn in citing instances where the president of the republic of Ghana, His Excellency John Dramani Mahama was sworn in while the case challenging his legitimacy was still in court.
The counsel of the petitioners Derrick Ackah however raised an objection by stating that, the application was not put in written therefore should be thrown away. The bench however disagreed on the grounds that: had the petitioners attended the court sitting on Saturday, they would have got the details of the application earlier.
The court after recess on Monday 4th of May 2015 declared that Davis Ohene Fobi be sworn in. This did not go down well with the counsel of the petitioners who walked out from the court room.
However the petitioners Jeffery Kwabena Yeboah and Worlu Great Damzi who were not satisfied with the way the court proceedings is going have taken the case to the High Court of Justice of the Republic of Ghana requesting an interlocutory injunction on the court petition and the swearing in of the SRC president elect. A Writ of Sermon was served on the under listed Defendants who are supposed to file an appearance within eight days after receiving the Writ.
